This statistic distributes the main causes for minors to be admitted into a care home in Spain as of December 2019. During that year, situations in which the minors involved were declared in abandonment, legally known as ex lege custody, comprised the most common reason for children's home admissions in Spain that year, with figures reaching 55 percent of all cases under the Spanish child protection system.
Percentage distribution of the most common causes of children's care home admission in Spain as of December 2019
- Ex lege custody: decision reached by the appropriate authority by which the minor in question is declared in abandonment. By this decision, the child is then given custody through the ministry of Law. In practice, this decision implies the child's custody.
- Guardianship: decision reached by the appropriate authority by which the state takes responsibility of the child's custody. Unlike ex lege custody, declaration of abandonment is not required by the appropriate authority.
- Under consideration prior to the protective measure: files in the process of analysis prior to passing a protective decision. Those cases that have already been allocated a protective decision are not included under this section, notwithstanding that the case is being under consideration for amendments or cessation.
- Voluntary relinquishment of guardianship: the legal guardian of the minors voluntarily forfeit their parental rights on the grounds that they do not have the means to provide for them. The local authorities therefore takes over the guardianship of the minors.
- Temporary guardianship: decision reached by the appropriate authority by which the state temporarily takes responsibility of the child's custody. This can be solicited by the legal guardians or by the local authorities.
