In French criminal courts, the clearance rate was higher than the European median for the supreme court and the second instance, but lower for the first instance in 2020. For instance, the clearance rate in criminal courts of second instance was 102.4 percent in France, compared to the European median of 99.4 percent.
In addition, a clearance rate exceeding 100 percent means that the court is able to resolve more cases than it has been seized with, and thus that the backlog of cases is decreasing. The backlog of cases was therefore greatest in first instance criminal courts in 2020, both in France and in Europe.
