As of 2022, the largest financial payout stemming from a fossil fuel investor-state dispute settlement (ISDS) was the 2014 case of Hulley Enterprises v. Russia. A United Nations Commission on International Trade Law tribunal awarded Hulley Enterprises 40 billion U.S. dollars in compensation after it found Russia's actions toward Hulley Enterprises to be in breach of the 2005 Energy Charter Treaty.
The Energy Charter Treaty is just one of thousands of international treaties that allow investors to sue countries when new regulations threaten their investments. While these treaties were meant to encourage foreign direct investment, it also allows for significant financial losses stemming from fossil fuel investor-state dispute settlement (ISDS).
