In France, the moment of separation from an ex-spouse is the one that presents the most risk for female victims of domestic violence. One of the measures put in place by the government to limit these risks and protect victims is the protection order, which allows a family court judge to ensure the protection of victims of domestic violence in an emergency.
To protect the victim, a judge can impose several prohibitions on the defendant: from contacting the victim, from going to certain designated places, from possessing or carrying a weapon, and from approaching the victim within a certain distance. The court may also require the offender to wear a restraining bracelet, if the victim requests a restraining order in advance.
Failure to comply with the measures imposed in the protection order is an offence punishable by two years imprisonment and a fine of 15,000 euros.
In 2020, the jurisdictions in which the greatest number of protection orders were issued per Court of Appeal were Île-de-France (361), Provence-Alpes-Côte d'Azur (167), and Occitanie (127).
